Plant Variety Rights

With a plant variety right varieties can be protected that are distinct, uniform, stable and new. Before grant there is a technical examination. The term of the plant variety right ends at the end of the 25th calendar year or, in the case of varieties of vine and tree species, at the end of the 30th calendar year, following the year of grant.

The plant variety right has the effect that production or reproduction, conditioning for the purpose of propagation, offering for sale, selling or other marketing, exporting, importing and stocking for any of the above mentioned purposes require the authorisation of the holder, but only if these acts are not done privately and for non-commercial purposes, for experimental purposes or for the purpose of breeding, or discovering and developing other varieties
